CALINACHI — EU/EEA MASTER TERMS & CONDITIONS (All Brand Websites)

These Terms & Conditions (“Terms”) apply to all websites and online stores operated under the CALINACHI brand that target customers in the European Union / European Economic Area (EU/EEA) (together, the “CALINACHI Websites”), including any of our country domains and subdomains (the “Website”).

By accessing the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

1) Who We Are (Seller)

Unless a specific Country/Domain Addendum states otherwise, the seller is:

If a particular domain is operated by a different legal entity, the applicable seller details will be stated clearly at checkout and in the Country/Domain Addendum.

2) Scope & Priority

These Terms govern:

  1. Website use (browsing, accounts, content), and

  2. Sales contracts (orders, payment, delivery, returns) for EU/EEA consumers.

If any Country/Domain Addendum conflicts with these Terms, the Addendum prevails only for that domain/country.

3) Definitions

  • Consumer: natural person acting outside trade/business.

  • Business Customer (B2B): purchasing for professional purposes.

  • Products: goods offered for sale.

  • Order: purchase request submitted via checkout.
    Mandatory EU consumer rights always apply and are not limited by these Terms.

4) Accounts (Optional)

Ordering may be available with or without account creation. You must provide accurate information and keep credentials secure.

5) Product Information

We aim for accuracy in descriptions, ingredient lists, and images. Minor variations may occur due to packaging updates, batch differences, or screen settings.

6) Prices, VAT & Currency

  • Prices shown include VAT unless stated otherwise.

  • Shipping costs are displayed at checkout before you confirm the order.

  • The final price is the amount shown at checkout in the selected currency.
    Bank/payment provider fees and conversion rates are outside our control.

7) Contract Formation

The contract is formed when we confirm your order by email and/or dispatch the goods (as described in the checkout flow). If we cannot accept an order, we will inform you and refund any charged amounts.

8) Delivery (EU/EEA)

We deliver to EU/EEA destinations enabled in checkout for each domain/country.

Unless otherwise agreed, delivery is made without undue delay and no later than 30 days after the contract is concluded.

Risk transfers to the consumer upon physical possession by the consumer (or a nominated recipient), unless mandatory rules provide otherwise.

9) Right of Withdrawal (14 Days) + Cosmetics Hygiene Exception

Consumers have a 14-day right of withdrawal from the day of delivery.

Cosmetics / Hygiene: the right of withdrawal does not apply to sealed goods not suitable for return due to health protection or hygiene reasons once unsealed after delivery (common for cosmetics).
Details and procedure are in the Return & Refund Policy, which forms part of these Terms.

10) Refunds (Withdrawal)

Refunds are issued within 14 days of withdrawal notice, but may be withheld until goods/proof of return is received. Standard delivery costs are refunded where required by EU rules.

11) Defective / Incorrect Goods — Legal Guarantee

If goods are defective, damaged, or incorrect, contact support with photos and your order number. EU consumers benefit from a minimum 2-year legal guarantee of conformity.

12) Reviews & User Content

User content must be lawful and truthful. We may remove content that violates laws or rights.

13) Intellectual Property

All content and trademarks on the Website are protected. No commercial reuse without written permission.

14) Acceptable Use

No hacking, malware, data scraping, impersonation, or unlawful use.

15) Privacy & Cookies

Personal data is processed under GDPR and applicable ePrivacy rules. See our Privacy Policy and Cookie Policy.

16) Marketing Communications

Marketing messages are sent only where permitted by law, typically based on explicit opt-in. You can unsubscribe anytime.

17) Changes

We may update these Terms by posting a new version and effective date. Orders remain governed by the version applicable at purchase.

18) Governing Law & Consumer Rights

These Terms are governed by the law of the Seller’s establishment without prejudice to mandatory consumer protections in the consumer’s country of residence within the EU/EEA.

The EU ODR platform was discontinued on 20 July 2025. Consumers may still use ADR mechanisms where available nationally.

20) Country/Domain Addenda (How to Use This for Every Domain)

For each domain (example: calinachi.bg / calinachi.ro / calinachi.eu), publish a short addendum with only the differences, such as:

  • Seller legal entity (if different)

  • Support email (if different)

  • Currency and payment methods

  • Shipping zones & carriers

  • Local mandatory notices (if any)

If there are no differences, the addendum can simply state:
“No deviations apply for this domain. The EU/EEA Master Terms & Conditions apply in full.”
